NISSAN GT SPORT CUP

Specific & General Rules of Entry

THE TERMS WITH CAPITAL LETTERS SET OUT BELOW HAVE SPECIAL MEANINGS:

“COMPETITION” the NISSAN GT SPORT CUP is a competition linked to the FIA GT Championship Manufacturer Series (hereafter referred to as the Manufacturer Series). The competition is open to participants of the Manufacturers Series who have contracted to Nissan and meet the Eligibility requirements set out within this document. The best drivers can win spot prizes, an invite to the Barcelona Final during the final round of the 2018 Blancpain GT Series Endurance Cup and trip to Japan to visit the Nismo Festival and Polyphony Digital Inc. headquarters in Tokyo.
“ONLINE QUALIFICATION” Players in the Manufacturer Series who contract to Nissan are automatically enrolled into the NISSAN GT SPORT CUP, no further registration is required. The highest ranked Nissan contracted drivers can win prizes. Exact details of the qualification process and prizes are set out within this document.
“GENERAL RULES” the general rules which apply to this Competition and which can be found in Part D.
“PRIZES” the players (3) in Territory A that proceed to represent Nissan at the Manufacturer Series World Final win a trip to Japan, Nissan team kit and access to a Nissan mentor. The overall winner of the Barcelona Final in Territory B wins a trip to Japan. In Territory B, spot prizes are available in June, July and August for the No.1 ranked Nissan contracted driver. Details of all prizes are set out in this document.
“BARCELONA FINAL” the invitation to participate in the “NISSAN GT SPORT CUP FINAL” event which may be up to 4 days in duration to take place at Circuit de Barcelona-Catalunya (or any other European venue, as the Organiser may select at its sole discretion).
“ORGANISER” GTA Global Ltd
“SPECIFIC RULES” specific rules of this competition on eligibility, entry and participation as detailed herein
“TERMS” the Specific Rules and the General Rules.
“TERRITORY A” Refers to the group of countries listed on Appendix 1.
“TERRITORY B” Refers to the group of countries listed on Appendix 2.

OTHER TERMS USED HEREIN AND WITH SPECIAL MEANINGS (AND CAPITAL LETTERS) ARE SET OUT BELOW IN BOLD/QUOTES.

PART A: ELIGIBILITY AND ENTRY REQUIREMENTS

  1. Eligibility
    1. This Competition is open to residents of Territory A & B who fulfil the entry criteria described below, except employees, agents, contractors or consultants of the Organiser, Nissan Motor Co., Ltd group of companies (“Nissan”) and Sony Interactive Entertainment Europe Limited (“Sony”), their families, subsidiaries, affiliates and associated companies and anyone professionally connected with the Competition (who shall not be entitled to enter), (the “Entrants”).
    2. Entrants may only enter the Competition if they have permanent residence in one of the “Territory” countries. For the avoidance of doubt, this is the country where you live at the time of entering and for duration of the Competition, it is where you live and work or study and where you do or would pay taxes.
    3. To enter this Competition, each Entrant must:
      1. be a permanent resident in a country listed as part of Territory A & B;
      2. be aged 18 years or over;
      3. hold a valid passport issued by the appropriate government agency of the Territory A & B and be capable of obtaining the appropriate visa (at the Entrant’s own cost) to enter Spain for the Barcelona Final and Japan for the Prize;
      4. have not been convicted of any criminal offence or is the subject of, or part to a criminal, civil or administrative proceeding as a party litigant;
    4. By entering the Competition, each Entrant promises he/she fulfils the above entry requirements. The Organiser reserves the right to verify the eligibility of Entrants at any time during the Competition, which includes, but is not limited to requesting copies of any Entrant’s passports, driving licences, government issued IDs, competent proof of identity, and residence.  Failure to comply with any verification procedures operated by the Organiser will result in disqualification from the Competition and/or withdrawal of the invite to attend the Barcelona Final. In the event of any dispute concerning the eligibility of any Entrant to participate in the Competition, the Organiser’s decision shall be final, and no appeal shall be allowed or entertained.
  2. Other Requirements
    1. The Competition is free to enter, and no purchase of any kind is necessary but Entrants must own or have access to a PlayStation®4 and a copy of Gran Turismo® Sport for PlayStation®4 (“Game”). Entrants must be active PlayStation®Plus members during the Competition Period. By entering the Competition, Entrants accept and will be bound by these terms and conditions (“Terms”).
    2. PlayStation®Plus subscription only available to SEN account holders with access to PlayStation®Store and high-speed internet.  PSN, PS Store and PS Plus subject to terms of use and country and language restrictions; PS Plus content and services vary by subscriber age. Users must be 7 years or older and users under 18 require parental consent, except that users in Germany must be 18 years or older. Service availability is not guaranteed. Online features of specific games may be withdrawn on reasonable notice – eu.playstation.com/gameservers.  PS Plus subscription automatically renews at the end of the subscription period at the current PS Store price. Full terms apply: PSN Terms of Service at eu.playstation.com/legal.

PART B: HOW TO ENTER

  1. Entry
    1. To enter this Competition, Entrants must follow:
      1. all of the steps set out below during the Online Entry Period for the Online Qualification;
    2. In the event that an Entrant becomes a Qualifying Entrant (as defined below) via the Online Qualification they shall be considered a Qualifying Entrant from their first route of qualification and disqualified from their second route of qualification, as detailed in clause 6.4.
  2. Qualification Period
    1. The Qualification Period for receipt of entries to participate at the “Barcelona Final” Event is from 20th June at 16:45 GMT 2018 to 8th September 2018 at 23:59 (“Entry Period”).  

PART B: HOW TO ENTER

  1. Entry
    1. To enter this Competition, Entrants must follow:
      1. all the steps set out at Section 6 below during the Qualification Period for Online Qualification.
  2. Territory A Qualifying process via the Manufacturer Series
    1. Sony will be hosting the inaugural Manufacturers Series from the Sport area within the GT Sport game. As part of the entry requirements for this competition entrants are required to choose a “Manufacturer” to “contract” to for the duration of the competition. To qualify for the Nissan GT Sport Cup entrants will need to have “contracted” to Nissan as their Manufacturer to represent in the competition.
    2. Each month (“season”) Sony will host a series of online races which entrants are able to enter and accumulate points.
    3. The player that scores the most points for Nissan in each of the three (3) regions as defined by Territory A proceed to represent Nissan at the World Final and become “World Finalists”. For clarity, this means one (1) player from each of the three (3) regions as defined by Territory A therefore a total of three (3) players.
  3. Territory B Qualifying process via the Manufacturer Series
    1. Sony will be hosting the inaugural Manufacturers Series from the Sport area within the GT Sport game. As part of the entry requirements for this competition entrants are required to choose a “Manufacturer” to “contract” to for the duration of the competition. To qualify for the Nissan GT Sport Cup entrants will need to have “contracted” to Nissan as their Manufacturer to represent in the competition.
    2. Each month (“season”) Sony will host a series of online races which entrants are able to enter and accumulate points.
    3. The Twelve (12) Entrants from Territory B who accumulate the most points during each of the following Manufacturers Series seasons; Season 1 (20th – 30th June 2018), Season 2 (4th -28th July and Final Season (8th August – 8th September 2018) will be invited to compete at the Barcelona Final (36 in total across the 3 seasons) and thereafter referred to as “Qualifying Entrants”.
    4. If a “Qualifying Entrant” qualifies more than once then their place will be offered to the next eligible “Qualifying Entrant” in that month that hasn’t already qualified. E.g the 13th ranked Nissan driver that month.
    5. (“Qualifying Entrants”) will be invited to compete at the Barcelona Final event hosted at the final round on the 2018 Blancpain Endurance Cup from 28-30 September 2018 (“BARCELONA FINAL”).
    6. Entrants must act within the spirit of the Game and comply with any and all instructions provided within the Game.  The Organiser reserves the right to disqualify Entrants for unsportspersonlike conduct. Entrants who cheat by any means, including cutting corners and exploiting glitches or any other unintended functionality in the Game, will be disqualified.
    7. The Organiser’s decision is final, and no correspondence or discussion will be entered into.

PART C: THE BARCELONA FINAL

  1. BARCELONA FINAL INVITATION
    1. All Qualifying Entrants will be contacted by the Organiser via email, to the email address linked to their PSN account as soon as practicable after the end of the Entry Period and shall be invited to take part in the “Barcelona Final”.  Each Qualifying Entrant must confirm their attendance at the “Barcelona Final” by replying to the Organisers email within five (5) days of the date it was sent by the Organiser or that Qualifying Entrant ceases to be a Qualifying Entrant.
    2. If a Qualifying Entrant does not wish to continue participating in the Competition or fails to claim their place within the relevant deadline or is disqualified from the Competition in accordance with these Terms or for failure to comply with these Terms, they will cease to be a Qualifying Entrant and the Organiser may, at its sole discretion, select a substitute Entrant to become a Qualifying Entrant. Such substitute Entrant shall be the Entrant from Territory B who achieved the next best performance. The Organiser shall repeat this process until the number of Entrants required to participate in the Barcelona Final Prize Event is reached.
  2. THE BARCELONA FINAL
    1. BARCELONA FINAL will be an event that it is intended to take place at the Circuit de Barcelona-Catalunya on 28th – 30th September during the final round of the 2018 Blancpain Endurance Cup, however, the Organiser reserves the right to select any date for the BARCELONA FINAL.  
    2. The following shall be arranged for each Qualifying Entrant for the Barcelona Final:
      1. economy class flight from an international airport, or standard fare train/coach travel from a train or coach station, (as applicable or appropriate) in the Qualifying Entrants country of residence in Territory B (“Winner Location”) to the airport, train or coach station (as the case may be) closest to BARCELONA FINAL location (as determined by the Organiser);
      2. economy class flight or standard fare train/coach travel, as applicable or appropriate, to the Winner Location from the airport, train or coach station (as the case may be) closest to BARCELONA FINAL (as determined by the Organiser);
      3. transfers to and from the relevant airport, train or coach station (as the case may be);
      4. accommodation during the BARCELONA FINAL;
      5. meals at times determined by the Organiser whilst participating in the BARCELONA FINAL;
      6. Tickets and Grid walk passes for the 2018 Blancpain Endurance Cup event taking place at the Circuit de Barcelona-Catalunya
    3. Qualifying Entrants are responsible for any expenses they incur in attending the Barcelona Final, other than that specified above at rule 8.2.  
    4. Qualifying Entrants are responsible for transport to and from their home and their nearest international airport or train/coach station.  Territory B Final Winners are strongly recommended to have up-to-date medical and travel insurance. These shall all be at the Territory B Final Winners’ own cost.
    5. During the BARCELONA FINAL, Qualifying Entrants will:
      1. compete in a series of online races against other Qualifying Entrants, as well as against winners from a “Wildcard” Competition that will be held at the Circuit de Barcelona-Catalunya the same weekend, to determine the overall winner of the Barcelona Final.

PART D: PRIZES

  1. PRIZES
    1. The player contracted to Nissan that scores the most points (No.1) from each of the three (3) regions (“Prize Winner/s”), defined by the Manufacturer Series structure, see https://www.gran-turismo.com/us/gtsport/fia2018/detail/, win a trip to the Nismo Festival and visit to Polyphony Digital Inc. headquarters in Japan, Tokyo (“PRIZE EVENT”). Dates are to be confirmed. In addition, they will receive Nissan team kit and access to a mentor.
    2. The winner (“Prize Winner/s”) of the BARCELONA FINAL shall win a trip to the Nismo Festival and visit to Polyphony Digital Inc. headquarters in Japan, Tokyo (“PRIZE EVENT”). Dates are to be confirmed.
    3. The top ranked (No.1) driver (“Prize Winner/s”) in Territory B (Europe) each month (June 2018, July 2018 and August 2018) will win a Track Experience at Silverstone Circuit UK (“PRIZE EVENT”). Dates to be confirmed.
    4. The following shall be arranged for each Prize Winner/s for attendance at Nismo Festival, Polyphony Digital Inc. visit in Japan and Silverstone Track Experience in the United Kingdom (“PRIZE LOCATION”):
      1. economy class flight from an international airport, or standard fare train/coach travel from a train or coach station, (as applicable or appropriate) in the Prize Winner/s country of residence (“Winner Location”) to the airport, train or coach station (as the case may be) closest to PRIZE LOCATION (as determined by the Organiser);
      2. economy class flight or standard fare train/coach travel, as applicable or appropriate, to the Winner Location from the airport, train or coach station (as the case may be) closest to PRIZE LOCATION (as determined by the Organiser);
      3. transfers to and from the relevant airport, train or coach station (as the case may be);
      4. accommodation during the PRIZE EVENT;
      5. meals at times determined by the Organiser whilst participating in the PRIZE EVENT;

PART E: GENERAL

  1. General – Competition
    1. By entering the Competition, Entrants accept and will be bound by these Terms.
    2. The Organiser cannot accept responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of or unauthorised access to entries, or entries lost, damaged or delayed as a result of server functions, technical issues, virus, bugs or other causes outside the Organiser’s reasonable control.
    3. The Organiser reserves the right to disqualify any Entrant if it has reasonable grounds to believe the Entrant:
    4. has not fulfilled all the relevant entry criteria;
    5. has supplied untruthful, inaccurate or misleading personal details and/or information;
    6. is in breach of these Terms;
    7. has failed to abide by any reasonable instructions given by the Organiser, during the Competition and/or
    8. has failed to compete in the spirit of fair play as determined by the Organiser.
    9. In the event of unforeseen circumstances or in its absolute discretion if it so wishes to do so, the Organiser reserves the right to (i) substitute the Barcelona Final and Prize Event (or any part of it) for an alternative of equal or greater value; and/or (ii) amend, alter or cancel the Competition.  No cash alternative will be offered. In the event of cancellation/amendment of the Competition or substitution of the Barcelona Final and Prize Event, each Entrant expressly agrees that, to the fullest extent permitted under applicable laws, no Entrant will be entitled to any compensation.  The decision of the judges and/or the Organiser is final, and no correspondence or discussion will be entered into.
    10. If an Entrant, Qualifying Entrant is disqualified or is unable to attend any part of the Competition or the Barcelona Final and Prize Event, the Organiser reserves the right to appoint a substitute Entrant selected in accordance with these Terms.  For the avoidance of doubt, (i) an Entrant can withdraw from participating in the Competition and/or the Barcelona Final and Prize Event at any stage; (ii) the Organiser reserves the right to disqualify an Entrant at any stage in accordance with these Terms; and (iii) any Entrant who withdraws or is disqualified shall not be entitled to any compensation in relation to such withdrawal or disqualification.
    11. No expenses will be covered other than those expressly stated to be covered in these Terms.  The Organiser shall be responsible for making any relevant travel or accommodation arrangements that are expressly referred to in these Terms and will not compensate any Entrant for arrangements made by Entrants themselves.
    12. Qualifying Entrants must ensure that they are available to attend all aspects of the Competition and, where relevant, any events forming part of the Nissan GT Sport Cup Prize.  The Organiser shall have no liability to an Entrant who is unable to attend or take part in the Competition or the Barcelona Final and Prize Event (or any part of it) for whatever reason.
    13. Motor racing is dangerous and can involve injury or death.  By attending any training or racing events forming part of the Competition and/or the Barcelona Final and Prize Event, Entrants acknowledge this and confirm that they are aware of the nature of the activity and agree to attend at any racing locations at their own risk.  Neither the Organiser or their respective directors, employees, affiliates, agents and/or representatives shall be responsible for any loss, damage or injury to persons or property caused or sustained by any Entrant as a result of attendance at any racing location, save for liability for death or personal injury arising from the Organiser’s or their respective directors’, employees’, affiliates’, agents’ and/or representatives’ negligence or for fraudulent misrepresentation or for anything else that cannot be excluded or limited by applicable law.
    14. Qualifying Entrants’ details (name and country) will be made available on www.nismo.com and www.gran-turismo.com.  Entrants hereby consent to the disclosure of such Personal Data (as defined below) on such website(s).
    15. Qualifying Entrants and winners of any part of the Barcelona Final and Prize Event shall co-operate with all publicity arising from this Competition.
    16. The Organiser (or any third party nominated by the Organiser) may exercise its sole discretion to use any Qualifying Entrant’s, and/or any Prize Winner’s, name, images and comments relating to the Nissan GT Sport Cup Prize, the Gran Turismo series of games and Competition experience for future promotional, marketing and publicity purposes in connection with the Competition (and future similar competitions), in any media worldwide without notice or without any fee being paid.
    17. Entrants who are invited to the Barcelona Final or win a Prize Event may be required to pay tax on in accordance with their jurisdiction’s tax legislation.
    18. These Terms shall be governed by English law and the courts of England and Wales shall have exclusive jurisdiction over any dispute arising from running the Competition or the Nissan GT Sport Cup.
    19. In these Terms, unless otherwise specified, reference to: (i) “includes” and “including” shall mean includes and including without limitation; (ii) the Organiser includes its permitted assignees and/or the successors in title; (iii) a statute or statutory instrument or any of their provisions is to be construed as a reference to that statute or statutory instrument or such provision as the same may have been or may hereafter be amended or re-enacted; (iv) words denoting the singular shall include the plural and vice versa and words denoting any gender shall include all genders; (v) Rules, Parts and Sections are to Rules, Parts and Sections of these Terms; and (vi) the headings in these Terms are for information only and are to be ignored in construing the same.

PART F: DATA PROTECTION

  1. Data Protection
    1. Any information (including data and images) related to an Entrant (“Personal Data”, as defined in the General Data Protection Regulations which also defines “Processed”, “Processor” and “Data Controller”), that is collected or Processed (which includes collection, storing, holding and carrying out operations) by the Organiser at the beginning and during the course of the Competition will be held and used by the Organiser and their suppliers and contractors (e.g. travel agencies etc.) to administer the Competition, in accordance with these Terms. Entrants’ Personal Data shall also be passed to the Organiser’s suppliers and contractors (e.g. travel agencies, transport and accommodation companies, etc.) to administer the Barcelona Final and Prize Event. Aggregate, non-personal data may also be used by the Organiser for the purpose of undertaking market research or in facilitating reviews, developments and improvements to relevant services.  Entrants’ Personal Data may be used to send Entrants news and publicity material in relation to the Competition.
    2. By entering the Competition, all Entrants will have consented to the transfer of their Personal Data to the Organiser and to each of their suppliers, contractors and agents for the purposes of the administration of this Competition and the Barcelona Final and Prize Event and pursuant to these Terms.  The Organiser shall be the Data Controller and Processor of all Personal Data collected by the Organiser during the Competition, for the purposes of data protection regulations.
    3. The Organiser confirms that all Personal Data requested from an Entrant is necessary for the purposes of that Entrant participating in the Competition.  Entrants shall be entitled to access, rectify, complete, update, block or delete their Personal Data or to object to its processing by written communication to the Organiser.
